House Judiciary Committee Chairman Jim Jordan said the congressional investigation into former special counsel Jack Smith’s Trump-related probes keeps turning up more than lawmakers expected — and that the committee is now weighing additional criminal referrals.
Appearing Tuesday on Fox News Channel’s “Hannity,” the Ohio Republican told host Sean Hannity that the recurring lesson of his oversight work is that the reality has consistently outstripped initial suspicions, as Breitbart News reported.
“The line we always use is the only thing we get wrong in these investigations is it’s always worse than we thought,” Jordan said. “And we once again were proven right in that.”
Hannity had asked whether the committee was examining “other crimes” tied to the Smith investigations, noting that FBI officials in Washington had pushed back on some of the actions taken.
Referral Over Testimony
Jordan said the panel has already made one criminal referral related to Smith’s testimony, accusing him of lying to investigators about the scope of records he had obtained. According to Jordan, Smith told the committee he only had access to certain records when he had in fact obtained communications belonging to members of Congress.
“So, yeah, we’ve referred him for lying to us,” Jordan said. “He did that under oath about communications that he got access to of members of Congress that he told us he didn’t have access to communications, just the records. So we referred him for that.”
The chairman added that “there are other issues we’re looking at as well,” without specifying what those matters involve.
First Amendment Concerns Raised
Jordan also pointed to what he described as an effort by Smith’s team to limit former President Donald Trump’s public statements during the period when the investigations were active.
“He tried to keep President Trump from even talking during all of this,” Jordan said. “So all of those issues, I think, are there but now we’re going to look at this a little closer.”
Focus on Real-Time Monitoring
Hannity shifted the conversation to the use of real-time monitoring tools, specifically in relation to Susie Wiles — now White House chief of staff — who at the time was in frequent contact with the president’s allies, donors, political supporters and attorneys.
Jordan described the collection of such communications data as extreme, saying investigators were able to see who Wiles was speaking with, when calls occurred, how long they lasted and who she might contact afterward.
“That is crazy,” Jordan said. He added that similar monitoring was directed at the first lady and the first family, and later at the White House chief of staff’s office.
A ‘Long Pattern,’ Jordan Says
Jordan framed the Smith episode as the latest chapter in what he called a sustained Democratic effort against Trump stretching back a decade.
He cited the 2016 surveillance of an opposing campaign and the so-called Russia collusion narrative, followed in 2020 by a letter from 51 former intelligence officials describing the Hunter Biden laptop as a Russian information operation.
“And then in 2024, it was Jack Smith who was looking to indict the president and keep him from taking office, so much so that he’s willing to go get the communications of his chief of staff and his first family,” Jordan said.
The interview reflects the Judiciary Committee’s continued scrutiny of the federal investigations into Trump, which have been a central focus of Republican oversight efforts. Jordan did not indicate a timeline for any further referrals.
