Immigration and Customs Enforcement (ICE) has arrested an illegal alien who was released into the United States under the Biden administration and is accused of murder in Brazil, the agency said this month.

The arrest took place in Westborough, Massachusetts, where ICE agents took Maycon Souto Dos Reis into custody. Dos Reis, a Brazilian national, had been a fugitive from justice in his home country, where authorities had issued an arrest warrant in September 2024 after he was convicted of aggravated murder and sentenced to 14 years and three months in prison.

According to ICE officials, Dos Reis illegally crossed the U.S.-Mexico border in June 2024 — just months before the warrant was issued — and was released into the U.S. interior by the administration of former President Joe Biden. He had no known criminal record in the United States at the time of his border release, but was arrested in May for unlicensed operation of a motor vehicle in Southborough, Massachusetts.

David Wesling, an ICE official, characterized the arrest as another example of individuals the media often labels as “non-criminal” when, in reality, many are murderers, sexual predators, and gang members. “They simply do not have a criminal record in the United States,” Wesling said. “We will continue to pursue these dangerous criminal aliens that sanctuary politicians fight to protect.”

Dos Reis remains in ICE custody pending deportation to Brazil. The case has reignited debate over border enforcement and the release of illegal aliens into the country, particularly those with serious criminal histories abroad.

The arrest highlights ongoing concerns about the screening and monitoring of individuals who enter the U.S. without authorization, as well as the challenges of sharing criminal records between nations. While the Biden administration defended its border policies as humane and orderly, critics have pointed to cases like Dos Reis’s as evidence of gaps in the system.

ICE did not immediately respond to requests for additional comment on the specifics of Dos Reis’s arrest or his prior interactions with law enforcement.
