The tension in the Massachusetts courtroom reached a boil Friday morning as the judge and defense attorney in the Lindsay Clancy murder trial traded sharp words while jurors remained deadlocked after 36 hours of deliberation, according to live feeds and CBS News reporting.

Judge William Sullivan appeared ready to declare a mistrial, but he granted defense attorney Kevin Reddington one hour to argue for a stay before making that call, CBS News reported. The clash came as the jury, made up of nine women and three men, struggled to reach a unanimous verdict in the case of the former labor and delivery nurse accused of murdering her three children in Duxbury in January 2023.

At the heart of the dispute is a single holdout juror who, according to the jury foreperson, is refusing to apply the law on reasonable doubt. Reddington is convinced that juror believes Clancy is guilty, while the other 11 jurors believe she is not criminally responsible because she was mentally ill.

On Thursday, the judge brought the jury into the courtroom and instructed them on the meaning of reasonable doubt after they reported they could not reach a unanimous decision. But on Friday, Reddington argued the judge hadn’t been forceful enough — accusing him of “glossing over the issue” and being “soft” on the legal standard.

“I would ask that you specifically direct their attention to proof beyond a reasonable doubt and reinstruct them on that forcefully,” Reddington told the judge.

Judge Sullivan pushed back: “I think I did that yesterday, didn’t I?”

“You did it yesterday; you did it soft; you didn’t do it forcefully…” Reddington responded.

Sullivan cut in: “What do you want me to do, get a brass band?”

The courtroom exchange underscored how high the stakes have become as the jury nears the point where the judge must declare a mistrial if no verdict is reached. The judge had spoken to the jurors individually on Thursday after they indicated they were stuck. Reddington told the judge that one juror had said he would apply the law to the facts as instructed, but that the latest note made clear the panel is effectively 11 to one — with that juror refusing to apply the reasonable doubt standard to return a not guilty verdict.

“That juror told you that he would be able to apply the law to the facts as you asked him, and based on this note from this juror, it clearly and unequivocally indicates that they are basically 11 to one, and this person will not apply reasonable doubt to the evidence to return a not guilty verdict,” Reddington argued.

The Case Against Lindsay Clancy

Clancy, who appeared in court in a wheelchair and is unable to walk, is being tried for the murders of her three children — Cora, 5, Dawson, 3, and eight-month-old Callan — at her Duxbury home in January 2023. She lost the use of her legs after jumping from a window in a suicide attempt following the killings. She had admittedly strangled the children, reportedly saying she didn’t want to leave them motherless after taking her own life.

Her defense has centered on her mental state, arguing she was on a dozen different prescription drugs and was a casualty of psychiatric malpractice. She claims she heard a voice telling her to take the children’s lives after she sent her husband out on errands.

Supporters of Clancy, many of them women, have demonstrated outside the courthouse, hoping she will be found not criminally responsible. If she is found not guilty by reason of insanity, she would be sent to a state mental health facility.

Prosecutors, however, argue she committed premeditated first-degree murder — sending her husband out on errands specifically to carry out the killings.

The televised trial has captivated court watchers, with opinions sharply divided between those who see a grieving, mentally ill mother and those who see a calculated killer. The jury’s 36 hours of deliberation, and the visible frustration of the judge and defense attorney, have only intensified the public debate.

As the courtroom sparring continued, the judge’s decision on whether to declare a mistrial or push the jury to keep deliberating hung in the balance. The case, which has already drawn national attention, could now hinge on whether the judge reinstructs the jury on reasonable doubt — or whether the mistrial bell tolls first.
