The future of the Protect College Sports Act (PCSA) is in serious jeopardy as the Senate Commerce Committee warns that bipartisan support for the bill will evaporate if it isn’t passed before the current congressional session ends on January 3. A committee spokesperson told Sport & State that there is ‘no realistic path’ to secure the same level of bipartisan backing in 2027 and beyond.

Lame-Duck Session Looms as Last Chance
The bill, which aims to reshape college sports governance, passed the Senate in September with overwhelming bipartisan support (77-22). But with Democrats gaining ground in the midterms, House Republicans face a narrowing window to push it through before the new Congress takes over. The Commerce Committee spokesperson framed the lame-duck session as a critical opportunity, stating that passing the bill now would be a ‘significant win’ for former President Trump, HBCUs, women’s sports, and student athletes.

Legal Experts Doubt Last-Minute Revival
Sports law attorneys are skeptical of any last-minute breakthrough. Darren Heitner, founder of Heitner Legal, gave the bill just a 20% chance of passing the House, while college sports lawyer Mit Winter put the odds at ‘slim-to-none.’ The legislation, which would establish federal oversight of name, image, and likeness (NIL) rights for student-athletes, has faced resistance from some House members who argue it doesn’t go far enough in protecting athletes’ rights.

If the PCSA fails, college sports could face prolonged uncertainty as states continue passing conflicting NIL laws, creating a patchwork of regulations that complicate recruiting and competition. The Senate Commerce Committee’s stark warning suggests that without action now, federal intervention in college sports may remain stalled for years.
