Rep. Brandon Gill (R-TX) is warning that Democratic control of the House would bring an abrupt end to congressional investigations into birth tourism agencies โ the businesses that help foreign nationals travel to the United States to give birth โ and would redirect committee resources toward probing those who carry out deportations.
In a post on X, Gill framed the stakes in blunt terms: if Democrats win back the chamber, he wrote, “the gavels on our committees will be used to investigate the people removing illegal aliens from the country instead of to continue our investigations into the birth tourism companies circumventing America’s sovereignty.”
The Texas Republican’s warning, first reported by Breitbart News, comes as his oversight work on the issue is still unfolding. Earlier this year, Gill was leading a House Oversight Committee investigation into birth tourism agencies, according to Breitbart’s John Binder, who reported in May on the effort. Gill’s “Task Force on Defending Constitutional Rights and Exposing Institutional Abuses” sent letters to operations in Florida, Texas, and California.
Letters Sent to Agencies in Three States
The four agencies targeted by the task force, per Breitbart’s reporting, are Have My Baby in Miami, Florida; International Maternity Services and Doctores Para Ti, both based in El Paso, Texas; and an OB/GYN clinic in San Diego, California, operated by Dr. Athiya Javid.
Each letter requested documents related to the agencies’ childbirth packages. Among the materials Gill sought were records showing how foreign clients are coached on securing a temporary visa to enter the United States โ specifically, guidance on how to avoid explicitly stating that the purpose of their trip is to give birth.
In his letter to executives at Have My Baby in Miami, Gill acknowledged that giving birth in the U.S. is not inherently illegal for a foreign traveler. But he pointed to a different legal problem: misrepresenting one’s intentions when entering the country on a temporary visitor visa amounts to a violation of current law and is treated as visa fraud.
A Familiar Argument on the Right
The investigation fits into a broader push by some Republicans to tighten scrutiny of birth tourism, an industry that critics say exploits the 14th Amendment’s birthright citizenship guarantee and undermines the integrity of the visa system. Gill has paired his oversight work with media appearances, including a September segment on Fox News Channel’s The Will Cain Show, where he argued that “Democrats will impulsively side with illegal aliens, no matter what the facts are.”
That comment previews the political fight Gill is now trying to nationalize. His X post effectively asks voters to weigh two competing visions of congressional oversight: one that investigates the businesses facilitating birth tourism, and one that investigates the federal personnel enforcing immigration law. In Gill’s telling, those outcomes are mutually exclusive and hinge entirely on which party holds the majority after the next election.
Whether House Democrats would in fact dismantle the birth tourism inquiry is, for now, a prediction rather than a documented plan. Gill’s post does not point to any Democratic statement committing to such a course. But his warning reflects a broader reality of House oversight: investigations are creatures of the majority, and a change in party control typically means a change in what โ and whom โ committees investigate.
For the agencies that received letters from Gill’s task force, the practical consequence is uncertainty. Document requests that carry the implicit threat of subpoena power can lose their force the moment the gavels change hands. Gill’s message to his supporters is that the window for this particular probe may be closing โ and that its fate will be decided at the ballot box.
