The bipartisan Protect College Sports Act, once seen as a congressional lifeline for NCAA reforms, now teeters on collapse after Democrats secured both chambers in the midterm elections, legal experts tell Sport & State.

Clock Ticks on Lame-Duck Lifeline
Senator Ted Cruz’s bill sailed through the Senate in September with a 77-22 vote but faces near-impossible odds in the House’s abbreviated lame-duck session before Republicans relinquish control. “Democrats have no reason to cooperate on this bill now,” said sports attorney Mit Winter, who estimates passage chances at “slim-to-none.”

Darren Heitner, founder of Heitner Legal, puts the failure probability at 80%, citing House GOP leaders’ demands for amendments and Democratic disinterest in handing Republicans a last-minute victory. “Any change sends it back to the Senate,” he noted, “and Democrats won’t revive a bill their caucus opposes.”

Back to Square One
With the current Congressional session ending January 3, attorneys predict the legislation will die outright rather than face a rushed vote. “The underlying challenges aren’t going away,” said Minneapolis sports lawyer Christopher Pham, who expects Congress to revisit the issue under new terms in 2027.
Future proposals may include collective bargaining rights for athletes—a nonstarter in Cruz’s version—as Democrats push for broader player protections. “Power keeps shifting to conferences,” Winter tweeted post-election, citing the Big Ten’s recent NIL cap as evidence of the NCAA’s eroding authority.
Legal Wild West Looms
Heitner warns that without federal intervention, college sports will remain governed by piecemeal litigation and conflicting state laws. Antitrust challenges threaten current NIL and transfer rules, leaving athletes and schools in precarious limbo.
Pham stresses that any eventual deal must balance institutional stability with athlete rights: “The goal shouldn’t just be restoring control—it’s building a sustainable system.” But for now, the playing field remains unresolved as Washington’s political tides reshape the game.
