Former White House lawyer Ty Cobb accused the Justice Department of waging a broad, orchestrated assault on the machinery of American elections at President Donald Trump’s direction, pointing to a lawsuit against California, a surge in poll observers and the administration’s push against mail-in ballots.
Appearing Friday on CNN’s “OutFront,” Cobb argued the pattern has been visible for two years and is no longer hidden. “If people have been listening, frankly, it’s been out there in black and white for two years,” he said, according to Breitbart News’ account of the segment.
Cobb, a former federal prosecutor who served as White House counsel during Trump’s first term, laid out a sequence of actions he characterized as coordinated. He began with Trump’s first-day executive order targeting mail-in ballots, which he said courts quickly blocked for attempting something “clearly unconstitutional.” From there, he argued, the Justice Department picked up the effort.
The California lawsuit
Central to Cobb’s critique is a Justice Department lawsuit against California over roughly 20,000 voters. He said the department does not actually know whether any of those voters are improperly registered. “They don’t know for a fact that any of them are improperly on the rolls, but they gave California 48 hours and then they went to court,” Cobb said.
He described the rapid timeline — a two-day ultimatum followed by litigation — as evidence that the legal action was designed for political effect rather than to resolve a genuine administrative problem.
“It’s all pre-textual,” Cobb said. “It’s just the same thing.”
A thousand observers, and a different mission
Cobb also trained his fire on the deployment of what he said would be about a thousand poll observers — a figure he described as three times anything seen previously in American history.
What concerns him, he said, is the purpose behind the expansion. In past elections, he argued, observers were dispatched to ensure that minority voters and others could exercise their right to vote. This time, he contended, the intent is inverted: “These observers are there to try to develop a reason for Trump to declare an emergency.”
The claim echoes long-standing criticism from voting-rights advocates, who have warned that aggressive poll-watching can intimidate voters and suppress turnout in precincts that lean Democratic. Cobb’s framing goes further, casting the observers as evidence-gatherers for a possible executive action.
‘He doesn’t have anybody who refused this time’
Cobb closed by drawing a contrast with 2020, when, he said, Trump asked then-Attorney General Bill Barr to seize voting machines and ballots. Barr refused, Cobb noted.
“He doesn’t have anybody who refused this time,” Cobb said.
That line captures the core of Cobb’s warning: that the guardrails he believes held in the aftermath of the 2020 election are no longer in place, and that officials now running the Justice Department are more pliable than Barr proved to be. The implication is that the same requests — or ones like them — would be carried out rather than turned aside.
The White House and the Justice Department have not responded publicly to Cobb’s characterizations in the CNN appearance. The department has previously defended its election-related litigation as a lawful effort to enforce federal voting statutes, and supporters of stricter voter-roll maintenance argue that lawsuits like the California case are a routine exercise of that authority.
Cobb’s remarks add a prominent Republican voice to a Democratic-led chorus of alarm over the administration’s election posture. Whether the warnings translate into legal jeopardy for the department’s actions, or remain a cable-news argument, may depend on how courts treat the California suit and on how the poll-observer program unfolds in practice.
For now, Cobb’s assessment is blunt: across litigation, executive orders and poll monitoring, he sees a single campaign aimed at the election system itself, and he sees few institutional checks standing in its way.
