The British government has published a guide for asylum seekers that spells out basic legal and social norms in the UK, including that rape is a serious crime and that sex with children is illegal. The nine-page booklet, issued by the Home Office, is intended for new arrivals who apply for asylum, a process that applies to most migrants who cross the English Channel illegally.

The pamphlet’s section on rape explains that both parties must consent to sex “without threat or pressure” and that it is not acceptable to have sex with someone who is “asleep, drunk, or unable to respond.” It warns that non-consensual sex is a “serious crime” and that offenders “could go to prison, lose your support and accommodation, and it will affect your asylum claim.”

It also stresses that the legal age of consent in the UK is 16, and that sex with someone under that age is a crime, even if the minor says yes. “There are no exceptions to this rule,” the booklet states, repeating the same warning about prison and loss of support.

The Home Office also uses the document to emphasize gender equality, telling migrants that women can earn their own money, attend school and university, travel freely, and choose who they marry, without needing “permission from a husband, father, brother or any other man.”

Beyond criminal matters, the guide covers public decorum, including a ban on sexual harassment, even if the migrant believes it is a compliment. It discourages whistling or making kissing noises at people, following or blocking someone’s path, making rude gestures, or verbally abusing others based on gender, religion, or appearance. Taking sexual images or videos of people in public without consent is also prohibited.

Government defends dispersal plan

The publication comes as the Labour government, led by Prime Minister Andy Burnham, prepares to disperse asylum seekers into new communities across the country. Burnham has argued that middle-class areas need to take their “fair share” of the burden, and Home Secretary Shabana Mahmoud told The Times on Wednesday that the new accommodation model aims for a “fair spread” so that no single community bears the brunt.

Immigration Minister Anna Turley acknowledged the challenges, saying last week that previous placements of migrants in residential areas “put a huge burden on local communities and created real civil unrest.” She suggested the burden should now be shared more evenly rather than concentrated in working-class areas where the government gets better rental value.

Reform UK hits back

The pamphlet has drawn sharp criticism from Reform UK, which has pledged to deport all illegal migrants, deploy the Royal Navy to the Channel, and set up asylum processing centres in third countries like Albania. Reform UK Shadow Home Secretary Zia Yusuf said the guide is an admission that the government knows the risks of allowing these migrants into British communities.

“They know that they are a menace and they are living in taxpayer-funded hotels,” Yusuf said. “You are paying for their living costs in HMOs, in hotels. They are being dispersed all around the country, and they are in your local area. In some cases, they’re near schools.”

Yusuf reiterated Reform’s plan to put the Navy in the Channel with orders to prevent any unauthorized vessel from reaching British shores, and to detain and deport all illegal migrants allowed in by previous governments.

The government’s decision to distribute such a pamphlet has reignited the debate over immigration policy, with critics arguing that the need for such guidance highlights deeper problems with the current approach to asylum seekers.
