A conservative watchdog group is pressing Sen. Ted Cruz to open an oversight inquiry into Microsoft’s newly announced partnership with the American Federation of Teachers, arguing that handing the union a formal role in governing classroom AI puts a deeply partisan actor in charge of technology used by millions of students.
The Fair Election Fund made the request in a letter sent Tuesday to Cruz, the Texas Republican who chairs the Senate Judiciary Committee’s subcommittee on the Constitution and has previously scrutinized the tech giant. The Daily Wire obtained a copy of the letter.
At issue is a deal Microsoft unveiled last week with the AFT, one of the nation’s largest labor unions, establishing what the company described as a legally enforceable framework covering safety, privacy, and fairness standards for Microsoft’s AI tools in schools.
A Partnership With an ‘Equity’ Mandate
The agreement is being championed by AFT president Randi Weingarten, a prominent Democratic ally whose tenure leading the union has been marked by aggressive political advocacy. According to the source account, the pact includes an “equity” and “inclusion” provision requiring that the AI products “must be accessible and fair.”
Microsoft President Brad Smith framed the arrangement in expansive terms when it was announced, saying the partnership “sets a high bar for child privacy and AI safety” and promising to extend the agreement to “every school district across the country.”
That nationwide ambition is precisely what worries the Fair Election Fund, which contends that Microsoft is leveraging its ubiquity in American schools to advance an ideological program.
“The company is once again using its reach in American classrooms to advance a partisan agenda, shaping how the next generation thinks, what they trust, and how they vote,” the group wrote to Cruz. “It is doing so through a partner whose record of politicizing children’s education should disqualify her and the organization she runs from any seat at this table.”
Pandemic-Era Record Cited as Red Flag
The letter leans heavily on Weingarten’s and the AFT’s conduct during the COVID-19 pandemic, when the union pushed aggressively to keep schools shuttered for extended periods.
According to the source material, Weingarten repeatedly lobbied the Centers for Disease Control and Prevention to maintain school closures, and AFT officials suggested language that was ultimately incorporated into the agency’s February 2021 reopening guidance.
“The partner Microsoft has chosen for this arrangement is the same person who kept schools closed during COVID-19 — lobbying the CDC behind closed doors, with AFT officials suggesting language that was incorporated into the CDC’s February 2021 reopening guidance,” the group wrote.
The Fair Election Fund also pointed to the union’s political spending as evidence of partisan imbalance. According to the group, the overwhelming majority of the AFT’s political donations over the past two decades have gone to Democrats — a pattern the letter presents as disqualifying for an entity being given a formal say over how AI is deployed in classrooms.
Request for Scrutiny of AI Guidance
In its request to Cruz, the watchdog asked the senator to investigate the scope of the Microsoft-AFT agreement and to determine whether it grants either party any “editorial or content” discretion over what students see and learn.
The group accused both Microsoft and the union of trying to circumvent AI guidance issued by the White House in order “to entrench their own ideological standards in American classrooms.”
The letter represents the latest front in a longer-running conflict between Cruz and Microsoft. Last year, the senator pressed the company over its promotion of NewsGuard, an organization that has drawn conservative criticism for how it rates the reliability of news outlets. According to the source account, Microsoft publicly distanced itself from NewsGuard in February 2025 but did not remove all references from its website until months later — after the company continued to recommend NewsGuard as a trusted “fact-checker” for students.
The Fair Election Fund’s letter invokes that history directly, arguing that Microsoft has forfeited the benefit of the doubt.
“A corporation that has already lied to Congress and partnered with a union president who has consistently weaponized her position for political ends should not be trusted to set the terms for how AI shapes young American minds and influences elections,” the group wrote.
What Comes Next
It remains unclear whether Cruz will act on the request. His office has not publicly responded to the letter, and Microsoft and the AFT have not issued statements addressing the watchdog’s specific allegations.
The dispute lands amid a broader national argument over how artificial intelligence should be governed in schools. Districts across the country are weighing whether to adopt AI tutoring systems, writing assistants, and administrative tools, even as parents and lawmakers debate what guardrails should apply and who should set them.
Microsoft’s agreement with the AFT is unusual in that it is described as legally enforceable, giving a labor union a formal oversight role rather than a purely advisory one. That structure is the crux of the conservative objection: not necessarily that AI shouldn’t be used in classrooms, but that one of the country’s most politically active unions shouldn’t be the one writing the rules.
For its part, the AFT has long argued that teachers deserve a seat at the table when decisions are made about the tools used in their classrooms — a position the union is likely to repeat as the controversy unfolds. Whether that seat comes with veto power over content, curriculum, or product design is the question Cruz is now being asked to answer.
