Democrats in blue states have launched a legislative blitz aimed at undermining President Donald Trump’s immigration enforcement agenda, introducing nearly 250 pro-migrant bills across the country, according to a review by the left-leaning State Futures organization.
The analysis, reported by OregonLive, identified 242 pieces of legislation in 32 states, with roughly one-fifth already enacted into law. The measures range from restricting federal agents’ tactics to blocking new detention facilities, and they have sparked legal battles with the federal government. In some cases, even Democratic governors have vetoed the most aggressive proposals, fearing they go too far.
A Coordinated Push to Obstruct Federal Enforcement
The bills target a variety of federal immigration actions. Several proposals would ban federal law enforcement officers from wearing masks—a move President Trump has criticized as unconstitutional. Others seek to prevent federal agents from using undercover license plates, a practice the administration has sued to stop. Some measures would bar Immigration and Customs Enforcement (ICE) officers from using government property or prevent federal officials from opening new detention facilities.
State Futures, a progressive organization, noted that 53 bills have passed in 17 states, but most face legal review and lawsuits. The legislation is often championed by activist law firms, part of what critics describe as a broader “lawfare” attack on the administration.
Lawfare and Judicial Obstruction
The legislative push comes alongside a wave of legal challenges. According to a recent Breitbart News report, pro-amnesty groups have filed 20,000 lawsuits to block Trump’s immigration agenda. These cases are often heard by judges appointed by Democratic presidents, who have ruled against ICE detention in the vast majority of cases.
Data cited in the report show that judges appointed by President Joe Biden ruled against ICE in 92 percent of 5,914 cases, while Obama-appointed judges did so in 95 percent of 4,360 cases. Even judges appointed by President George W. Bush ruled against ICE in 90 percent of 3,072 cases. In contrast, Trump-nominated judges backed ICE in 34 percent of 3,946 cases, and Reagan-appointed judges supported detention in 36 percent of 352 cases.
James Percival, General Counsel for the Department of Homeland Security, said liberals are using the courts to obstruct the president’s mandate. “They know if they can just get enough crazy district judges to do enough crazy things, they can run out the clock,” he said.
Concerns Over Democratic Governors
While many blue-state Democrats are enthusiastic about the pro-migrant legislation, some governors have pushed back. In several states, Democratic governors vetoed measures they deemed too extreme, reflecting internal tensions over how aggressively to challenge federal immigration policy. The federal government has also filed lawsuits to block some of the enacted laws, setting the stage for prolonged legal battles.
The coordinated legislative effort underscores the deepening partisan divide over immigration, as states seek to assert their own policies in the face of federal enforcement priorities.
