An illegal alien from Honduras is behind bars in Florida, accused of a brutal home invasion and sexual assault of a 77-year-old woman, according to the Polk County Sheriff’s Office.
Axel Antonio Espinal Herrera, 24, was arrested and charged with forcible sexual battery, kidnapping, burglary with battery, tampering with evidence, cocaine possession, possession of drug paraphernalia, and loitering, authorities said.
Attack unfolded in the early morning hours
The incident began around 4 a.m. on August 29, when the victim told police she heard a noise and saw Herrera entering her bedroom. She said he ripped off her clothes and sexually assaulted her, slapping her when she tried to flee.
When the woman attempted to escape while Herrera was in the bathroom, he allegedly chased her down, dragged her back inside, and choked her before fleeing the scene.
Police responding to the call searched the neighborhood and came upon a residence with three occupants. Two were speaking with officers while a third — later identified as Herrera — was in the shower. He matched the description the woman had provided.
The victim subsequently identified Herrera from a photo lineup, leading to his arrest. The U.S. Immigration and Customs Enforcement (ICE) has placed a detainer on him, indicating he will be held for federal immigration proceedings after his criminal case.
The other two occupants of the home where Herrera was found are also illegal aliens from Honduras, and ICE has lodged detainers against them as well, according to the sheriff’s office.
The case highlights ongoing concerns about crimes committed by individuals in the country illegally, particularly in Florida, where state and federal authorities have been escalating cooperation on immigration enforcement.
Herrera remains in custody pending trial. The Polk County Sheriff’s Office did not immediately provide further comment on the investigation.
