Trump Threatens Jail for California Election Officials Over 200,000 Alleged Noncitizen Ballots

President Trump warned California officials they'll "all go to jail" if mail-in ballots from people flagged as potential noncitizens are counted, as the DOJ sues the state three weeks before Election Day.

Trump Threatens Jail for California Election Officials Over 200,000 Alleged Noncitizen Ballots

President Donald Trump warned Friday that California election officials could face prison time if they count mail-in ballots from roughly 200,000 people reportedly identified as potential noncitizens, escalating a standoff between his Justice Department and the nation’s most populous state just weeks before the midterm elections.

“They will all go to jail for a long period of time!!!” Trump wrote on Truth Social, according to Breitbart News. Alongside the post, the president shared a copy of a DOJ letter addressed to the Los Angeles County Counsel’s Office, which pledged “significant” consequences for officials found “facilitating or ignoring” what the department described as the “federal crime” of illegal voting in a federal election.

A Lawsuit and a 48-Hour Deadline

The warning follows a DOJ lawsuit filed Thursday against California. According to The Hill, the department gave state and local election officials a USB drive containing voter roll citizenship data and a 48-hour window to cross-check 20,000 names flagged by the Department of Homeland Security as non-U.S. citizens against the state’s own records. The DOJ had earlier sent officials a letter including the password needed to open the files on the drive.

The suit states that if California could not independently verify the citizenship of individuals on the list, the federal government asked the state to set aside ballots received from them until citizenship could be confirmed. The DOJ posted the complaint online, describing the move as a “courtesy to the public.”

Newsom Fires Back

Gov. Gavin Newsom, a Democrat, issued a written response calling the civil complaint a “sad, desperate attempt by Trump to use his politicized Justice Department to try to suppress California voters just three weeks before Election Day.”

“The courts have made clear that the federal government has no role in how a state carries out its election process, and now, in the middle of Californians voting, they have asked local officials — who do a damn good job defending democracy — to violate federal law,” Newsom said in the statement.

Legal Challenge From the UCLA Voting Rights Project

The administration’s voter data push was already facing resistance. In September, the UCLA Voting Rights Project sued the DOJ and DHS, questioning how the government arrived at its count of noncitizens on voter rolls, according to news reports cited by Breitbart.

The Hill reported that the group planned to seek a temporary restraining order if the administration did not abandon its plans for a criminal crackdown on California officials. Attorneys for the organization wrote in a recent letter to the DOJ that compiling the list violated established law, and that using it to purge voters less than a month before an election would run afoul of the National Voter Registration Act, among other statutes.

“Your clients’ actions in compiling the list violates established law; your efforts to employ this list to systematically purge voters, less than a month before the election, further violates the National Voter Registration Act, among other laws,” the attorneys wrote.

Disputed Numbers

The figures at the center of the fight have been contested from the start. Earlier this year, Trump alleged that California and three other states collectively had 250,000 noncitizens on their voter rolls, a claim his opponents dispute. The current dispute centers on the roughly 200,000 people reportedly flagged as potential noncitizens in California’s mail-in voting population.

The confrontation comes as early voting is already underway in California, adding urgency to both sides’ arguments. Federal officials frame the demand as a routine enforcement of citizenship requirements in federal elections; state leaders and voting rights advocates cast it as an eleventh-hour attempt to interfere with an election already in progress.

With the DOJ’s 48-hour window expiring and the lawsuit now in court, the next move may belong to a judge — unless California officials comply first. Trump’s message made clear he intends to keep the pressure on in the meantime.
