A Utah judge ruled Tuesday that Tyler Robinson, the 23-year-old man charged with murdering conservative activist Charlie Kirk, will face trial and could be sentenced to death if convicted. The decision keeps the death penalty on the table in a case that has drawn national attention.
Utah District Judge Tony Graf sided with prosecutors who said they had “a mountain of evidence” linking Robinson to the fatal shooting of Kirk at Utah Valley University last September. Kirk was addressing a crowd of thousands at an outdoor event when he was shot from a rooftop more than 400 feet away, according to the Associated Press.
Robinson has pleaded not guilty to aggravated murder, a capital offense in Utah, and six other charges connected to the shooting on September 10, 2025. He turned himself in the day after the attack, and his lawyers have not proposed an alternative explanation for Kirk’s death.
Death Penalty Fight
Robinson’s defense team had tried to prevent the case from going to trial or at least bar the death penalty as a possible sentence. They argued prosecutors failed to show that Kirk’s shooting endangered others around him—an aggravating factor under state law that makes the death penalty available.
Judge Graf rejected that argument, allowing the case to proceed with the possibility of capital punishment. Prosecutors assert Robinson acted with knowledge that he could have missed and killed other attendees at the open-air campus event.
Political Motivation Alleged
Prosecutors have sought to establish that Robinson targeted Kirk because of his politics. They pointed to a bullet found in the rifle—engraved with the phrase “Hey Facist! CATCH!”—as evidence of intent. They also alleged Robinson wrote in a text message: “I had enough of his hatred. Some hate can’t be negotiated out.”
Defense attorneys countered that prosecutors lack strong evidence to prove political motivation. They have not offered alternative theories for Kirk’s death, according to the AP report.
Family and Political Context
Kirk’s family welcomed Tuesday’s ruling, calling it “an important step in our family’s pursuit of justice.” In a statement, they said: “Every step in this process carries the weight of all that Charlie’s murder has taken from his family, especially his children who will grow up without their father.”
Kirk was 31 and the founder of Turning Point USA, a conservative youth organization. He played a prominent role in rallying young voters behind President Donald Trump’s successful 2024 campaign. Trump later honored Kirk in his State of the Union address, calling him a “martyr.”
