An illegal alien from El Salvador is facing vehicular manslaughter charges after an alleged drunk driving crash in Montgomery County, Maryland, a jurisdiction that has declared itself a sanctuary for immigrants, according to police and federal officials.
Jose Antonio Caballero-Nolasco, 32, was arrested and charged with two counts of negligent vehicular manslaughter and two counts of vehicular homicide with alcohol as a factor, law enforcement said.
The charges stem from an August 29 incident on Interstate 270, where Caballero-Nolasco is accused of driving the wrong way while intoxicated and slamming head-on into a vehicle carrying four people.
Two of the victims—46-year-old Musammat Shamima Begum and her 23-year-old daughter Areebah Jahin—died at the scene or shortly thereafter. Begum’s 8-year-old daughter sustained critical injuries in the crash, authorities said.
‘Completely Avoidable’ Tragedy, DHS Says
Department of Homeland Security (DHS) Secretary Markwayne Mullin issued a sharply worded statement condemning the crash and pointing to Caballero-Nolasco’s immigration status as a factor that should have prevented the tragedy.
“This illegal alien has been charged after a drunk-driving crash that killed a woman and her daughter and injured two others, including an 8-year-old girl, in Montgomery County, Maryland,” Mullin said.
“This tragedy was completely avoidable. Musammat Shamima Begum and Areebah Jahin should still be alive,” he continued. “ICE has lodged a detainer asking officials in Maryland to commit to not releasing this killer back onto our streets. My thoughts and prayers are with the victims and their family, and for a swift recovery for those who were injured.”
Mullin’s reference to a detainer underscores the broader policy clash between federal immigration enforcement and local jurisdictions that limit cooperation with U.S. Immigration and Customs Enforcement (ICE). Montgomery County, which sits just outside Washington, D.C., has long maintained sanctuary policies that bar local law enforcement from honoring ICE detainer requests unless accompanied by a judicial warrant.
Suspect Held, ICE Detainer Lodged
Caballero-Nolasco remains incarcerated at the Montgomery County Detention Center. ICE has filed a detainer against him, meaning the agency seeks to place him in federal custody for deportation proceedings if he is released from local jail at any point.
A detainer is a request from ICE to a local jail to hold an individual for up to 48 hours beyond their release date so federal agents can take them into custody. Under sanctuary policies, such requests are often ignored or refused unless a court order is presented—a practice that has drawn criticism from immigration enforcement advocates who argue that dangerous criminals slip back into communities.
In this case, ICE’s request is specifically aimed at ensuring Caballero-Nolasco does not walk free while facing two counts of vehicular homicide. The agency has highlighted the case as an example of the consequences of sanctuary policies.
As of press time, it was unclear whether the Montgomery County Detention Center would honor the detainer should Caballero-Nolasco post bail or otherwise be released pending trial. The county’s sanctuary ordinances do not require detention solely on the basis of an ICE request, and repeated attempts by federal officials to pressure local jurisdictions into compliance have met with legal resistance.
A Community Grieves
The crash has sent shockwaves through the local community, particularly among friends and family of the victims. Begum, a 46-year-old mother, and Jahin, her 23-year-old daughter, were described by those who knew them as cherished members of their community. Begum’s 8-year-old daughter remains hospitalized with critical injuries, according to reports.
The two other vehicle occupants, in addition to Begum and Jahin, were injured but survived, police said. Their conditions were not immediately disclosed.
The case has become a rallying point for immigration hardliners and a cautionary tale for sanctuary jurisdictions. Conservative commentators and politicians have seized on the incident as evidence that local policies shielding illegal aliens from federal enforcement place public safety at risk.
Proponents of sanctuary laws argue that such measures foster trust between immigrant communities and police, encouraging undocumented residents to report crimes without fear of deportation. But opponents point to cases like this one as the tragic cost of those policies.
Legal Proceedings Ahead
Caballero-Nolasco is due to appear in court in the coming weeks, where he will face the four felony charges. Prosecutors in Montgomery County will determine whether to elevate the charges or add others, depending on the results of blood alcohol tests and accident reconstruction.
Maryland law defines negligent vehicular manslaughter as causing death while driving in a criminally negligent manner, while vehicular homicide with alcohol as a factor is a more specific charge that applies when alcohol use is demonstrated. Both are serious offenses that carry significant prison time.
ICE officials have made clear they intend to pursue deportation proceedings against Caballero-Nolasco following any criminal case, regardless of the outcome. “We will not allow this individual to remain in our communities,” a DHS spokesperson said in a statement accompanying Mullin’s remarks.
The crash occurred on I-270, a major artery connecting Montgomery County with the Baltimore-Washington metropolitan area. The stretch where the collision happened is often congested, making wrong-way driving particularly hazardous. Police have not released a detailed timeline of how Caballero-Nolasco entered the highway in the wrong direction or how long he traveled before the fatal impact.
As the investigation continues, the focus remains on the victims and their family. “No mother should lose her daughter, no child should lose her mother in such a senseless act,” Mullin said. “We owe it to Musammat, Areebah, and the little girl fighting for her life to ensure that justice is served.”
